Handling a "Notice of Reasons for Rejection" After Filing a Patent Without a Patent Attorney [Revised Version]
(Q) I filed a patent application myself and received a "Notice of Reasons for Rejection."
Is it possible to engage a patent firm (or patent attorney) at this stage?
(A) It is difficult to give a general answer that applies to every situation.
However, our firm can accept such requests if the following conditions are met:
① You requested "accelerated examination," and the Notice of Reasons for Rejection was received shortly after filing.
② The content of the patent application documents meets a certain standard of quality.
In other words, these are cases similar to situations where we were engaged from the very beginning.
We accept requests in such cases (this is known as "mid-stream engagement").
Because there is still a wide range of options available, we can determine the best course of action.
At our firm, we ensure the optimal response by having:
✓ You—the person who best understands the "technology"—and
✓ A patent attorney—who best understands "patents" (and has experience as a patent examiner)
...examine the matter collaboratively.
Please note, however, that:
✓ We do not recommend filing a patent application yourself without a patent attorney.
✓ To aim for a robust patent, you should engage a patent attorney from the start.
That said, we understand that circumstances may sometimes lead you to file a patent application yourself.
Therefore, in certain situations, we do accept cases starting from the stage of the Notice of Reasons for Rejection.
■ Supplementary information regarding ①
You must submit a rebuttal to the Notice of Reasons for Rejection within 60 days.
The examiner will then conduct a re-examination based on that rebuttal.
In many cases, this re-examination leads to a final disposition (either a patent grant or a rejection).
If you have requested accelerated examination, this final disposition is issued sooner.
In case ①, the final disposition is issued within one year of the patent application filing.
Receiving a final disposition within one year of filing expands your range of options.
Details here:
What you can do when the examination result (patent grant or rejection) is issued within one year of filing
Of course, the final disposition might be a rejection. In such a case, one option is to add new content and file a new patent application.
The benefits of filing a new application are as described in the article above.
You can file an application that incorporates content designed to counter the reasons for rejection.
This increases the likelihood of the patent being granted.
Perhaps you filed the application yourself but now want a patent attorney to rewrite it...
We can accommodate such requests as well.
For these reasons, we include point ① as one of the conditions for accepting a case mid-stream.
■ Supplementary note on ②
Regarding point ②, we will actually review the content of the patent application and the reasons for rejection.
Thanks to our patent attorneys' experience as former patent examiners, we can make an initial assessment quite quickly.
If further analysis is required, formal engagement is necessary, and fees will apply.
When taking over a case mid-stream, the patent attorney must grasp the technical details from scratch.
Naturally, this can lead to higher costs.
Therefore, our firm ensures an optimal response while keeping costs down by having:
✓ You—the person who best understands the "technology"—and
✓ A patent attorney—the person who best understands "patents" (specifically, one with experience as an examiner)
...work together on the analysis.
■ With patent applications, the initial filing documents are everything
What did you think?
To reiterate, we do not recommend filing a patent application yourself.
We make point ② a condition because the initial filing documents are crucial to the patent's success.
Patents are, in many ways, an "all-or-nothing" proposition.
Furthermore, securing a robust patent requires a thorough patent search.
We strongly encourage you to engage a patent firm (or patent attorney) right from the initial stage.
