アイデアは特許でデザインは意匠で!(1/2)【リライト版】

(Q)アイデアともデザインとも言える新しい創作をしました。
何らかの権利を取りたいと思います。
「アイデア」と「デザイン」のどちらで権利を取ったらいいでしょう?

(A)創作の内容によってケースバイケースです。
以下、一般的なお話しをしたいと思います。

創作には、大きく分けて「アイデア」と「デザイン」があります。
「アイデア」で権利を取るか?「デザイン」で権利を取るか?

前者は、特許(または実用新案)で、権利化を目指すことができます。
後者は、意匠で、権利化を目指すことができます。

例えば、別の記事で、
「どんぶりの縁から落ちないように、切欠きを設けたレンゲ」
についてお話ししました。

✓「どんぶりの縁から落ちないための工夫」という「アイデア」に注目
→特許で権利化を目指すことができます。

✓「切欠きを設けた」という「デザイン」に注目
→意匠で権利化を目指すことができます。

特許で権利が取れれば、アイデアを保護することができます。
✓他者が同じアイデアを実施した場合
→デザインが異なっていても、権利を主張できます。

一方、意匠で権利が取れれば、デザインを保護することができます。
✓第三者が同一または類似のデザインを実施した場合
→アイデアが異なっていても、権利を主張できます。

意匠では「同一」の幅が狭いために「類似」の意匠まで保護されます。

創作と言えば、特許を思い浮かべることが多いと思います。
あなたの創作にアイデア+デザインの要素がある場合があるでしょう。
そんな場合は、特許に加えて意匠についても、検討の余地があります。

意匠も検討される場合には、気を付けることがいくつかあります
特許事務所(弁理士)に相談されるのが確実です。

If you secure a patent, you can protect the underlying idea.

✓ If another party implements the same idea

→ You can assert your rights even if the design differs.

On the other hand, if you secure a design right, you can protect the design itself.

✓ If a third party implements an identical or similar design

→ You can assert your rights even if the underlying idea differs.

With design rights, protection extends beyond "identical" designs to include "similar" designs as well.

When people think of "creations," patents often come to mind first.

However, your creation may incorporate elements of both an idea and a design.

In such cases, it is worth considering design rights in addition to patents.

There are several points to keep in mind if you are considering design rights.

Consulting a patent firm (patent attorney) is the most reliable approach.
