知的財産権(特許・商標・著作権)のフェイクニュースはどれくらいある?【リライト版】
これを「知財の流出」というのは、なにか意図があるのでしょうか?
こんなフェイクニュースもありました(笑)
そういったフェイクニュースは、やはり大きな問題と言えるでしょう。
理解できないわけではありません。
ただ、正当な模倣行為は、むしろ産業の発達に資するものです。
社会保険労務士は、未登録ですが試験合格しています。
顧問先を抱える社労士さんでは言いにくいこともお伝えできるかも!

How Much "Fake News" Is There Regarding Intellectual Property Rights (Patents, Trademarks, Copyrights)? [Revised Version]
I wrote an article recently titled:
"What If a Popular YouTuber Made a Video Containing Incorrect Information About Patents?"
So, just how much "fake news" is there regarding intellectual property rights?
Let’s consider the three main categories: patents, trademarks, and copyrights.
In this article, I am using the term "fake news" to simply mean "incorrect information."
I am basing this on information and news found online, such as on YouTube.
I plan to take the time to thoroughly research the actual situation later.
For now, I am sharing my personal impressions.
■ How much fake news is there regarding intellectual property rights?

✔ (2) Trademarks
✔ (3) Copyrights
■ (1) How much fake news is there regarding patents?
I don't think there is much fake news about patents.
To begin with, there isn't a great deal of information about patents circulating in the public sphere.
If I had to point something out, the phrase "leakage of intellectual property" has struck me as noteworthy.
"Leakage of technology"—does that imply industrial espionage?
Is there a specific intent behind calling it a "leakage of *intellectual property*"?
Come to think of it, there was a piece of fake news claiming, "Patent examiners *want* to reject patent applications."
(Haha!) I’ll write about the details of that in another article.
■ (2) How much fake news is there regarding trademarks?
There is somewhat more fake news regarding trademarks compared to patents.
I plan to investigate this further, but for this article, I’ll focus on just one point.
There is fake news claiming that a trademark amounts to a "monopoly on an expression."
The idea that one isn't even allowed to *utter* a certain expression!
That kind of fake news is certainly a significant issue.
■ (3) How much fake news is there regarding copyrights?
There is also somewhat more fake news regarding copyrights compared to patents.
I plan to investigate this further, but for this article, I’ll focus on just one point.
I feel that public scrutiny regarding acts of imitation is far too harsh. "Imitation" might not be the best word to use.
In this context, I am referring to imitation that does not violate the law (such as copyright laws).
People sometimes react emotionally to legitimate acts of imitation, calling them "unfair."
I can certainly understand that sentiment.
However, legitimate imitation actually contributes to industrial development.
■ Bonus (Topics related to Labor and Social Security Attorneys: labor issues, pension matters)
I will share information on these topics on this blog as I research them.
Incidentally, I also plan to share "fake news" regarding labor-related matters.
Although I am not currently registered as a Labor and Social Security Attorney, I have passed the qualifying exam.
This might allow me to discuss things that practicing attorneys with corporate clients might find difficult to say!
There is a great deal of public interest in labor and pension issues.
As for intellectual property rights, the first step is to raise public awareness.
