Why We Accept Requests Even When the Likelihood of Patentability Is Low [Revised Version]

Our patent firm specializes in serving individual clients.

Some clients come to us feeling that:

✓ Their invention is brilliant, but...

✓ ...getting a patent for it is likely impossible.

They may have even been told by others that obtaining a patent would be impossible.

(This includes feedback from patent experts, such as other patent firms or patent attorneys.)

Yet, they still chose to visit our firm.

Perhaps they simply weren't convinced by the earlier assessments that a patent was out of reach.

We accept requests even when the initial likelihood of obtaining a patent appears low.

This does not mean we simply accept every request that comes our way.

In fact, as explained below, the opposite is true.

A "low likelihood of patentability" is often a subjective assessment—

whether it stems from the client's (inventor's) own impression or the opinions of others.

The boundary between a "high" and "low" probability of success often feels rather vague.

That is why we carefully evaluate the potential for patentability.

Rather than simply accepting every request,

✓ We aim to accept cases with a high probability of success,

✓ Because we do not wish to encourage clients to pursue patents that are unlikely to be granted.

So, how do we go about this?

■ How do we carefully assess the likelihood of patentability?

When we say we accept a request, we are initially referring to a patent search.

Conducting a thorough patent search offers several benefits:

・If obtaining a patent is difficult, we can identify the objective reasons why.

・By "knowing the enemy" (understanding existing patents), we open up possibilities for improved inventions.

・It increases the likelihood of avoiding infringement on other companies' patents.

Then, only when:

✓ The patent search yields positive results, or

✓ Improvements to the invention make the likelihood of patentability sufficiently high...

...do we accept the next stage of the request.

In other words, we then accept the request to proceed with the actual patent application filing.

We handle requests in this two-step process. This enables a patent strategy free from overburden, waste, and unevenness.
