The Necessity of the Patent System and the Changing Times: "Attic Inventors" vs. Corporate R&D Teams [Revised Edition]

I am sometimes commissioned by companies to conduct patent seminars.

The attendees range from patent novices to experts.

Topics regarding patent examination can be overly complex.

So, I read various books to find engaging material.

I have a few books that were published about 30 years ago.

These are introductory books on patents that I read when I first entered the field.

In this article, I will discuss "the necessity of the patent system and the changing times."

I would like to share these concepts by adapting the content from those books.

■ "Attic Inventors" vs. Corporate R&D Teams

✓ In the early days of the patent system

The primary subjects of patent protection were "attic inventors."

In fact, the patent system was created specifically to protect these "attic inventors."

✓ However, in recent years (note: "recent" relative to 30 years ago),

it became nearly impossible for "attic inventors" to obtain patents.

Patents came to be dominated by "corporate R&D teams."

■ No Hierarchy of Value in Inventions

It is true that it is difficult for an individual to invent highly advanced technology in an attic.

For instance, inventing something in biotechnology or rocket science would be challenging for an individual.

However, inventions of everyday items (things that *can* be made in an attic) also qualify for patents.

They are no different from biotechnology or rocket inventions in that regard.

And there is no need to rank one type of invention as superior to another.

The sophistication of the technology itself and the sophistication of the invention (its "inventive step") are different matters entirely.

It is simply a case of the right people obtaining the patents they need.

You could say it is merely a matter of distinct roles and areas of activity.

■ The Internet Age: An Advantage for Individuals and Small Businesses

Thirty years ago takes us back to the "bubble economy" era.

The internet had not yet become as widespread as it is today.

Now, thirty years later, we live in an internet-driven society. Even an individual—an "attic inventor"—can create a wide variety of inventions.

It has also become possible to manufacture and sell these inventions.

In recent years, consumer tastes and preferences have become broader but shallower.

The trend toward mass consumption—which favored large corporations—has waned compared to the past.

This shift works to the advantage of the "attic inventor."

Furthermore, many inventions are born directly from practical experience, such as through the discovery of specific problems.

You do not necessarily need to be part of a corporate R&D team to spark an invention.

An individual in sales, administration, or human resources can just as easily create an invention.

■ The Spotlight Returns to the Individual Inventor!

Looking at the big picture, one could say the role of the primary inventor has shifted:

✓ From individuals → to large corporations → and now back to individuals.

It is true that large corporations account for the overwhelming majority of patent applications.

However, there are various underlying reasons for how patents are utilized.

It might be an exaggeration to claim that individual inventors are the absolute stars of the patent world.

Yet, there is no doubt that the current climate is favorable for individuals.

In this context, "individuals" includes small business owners.

The Japan Patent Office also offers reduced patent fees for individuals and small businesses.

Why not try your hand at becoming an "attic inventor" yourself?
