料理のレシピは知的財産として保護されるか？【AIなら問題？】
ニュース内の専門家の意見としては、
✓料理レシピに著作権なし？
✓レシピ考案者に利益還元考えるべきでは？
ここでいう専門家が何の専門家かはわかりません。
本記事では知的財産権の専門家である弁理士の意見を書いてみます。

■（１）料理レシピのアイデアは保護される？
料理のレシピのアイデア（内容）は保護されません。
アイデアが保護されるためには、
①そのアイデアが最初である（オリジナルである）ことが必要です
②そのアイデアを保護する法律が必要です
料理レシピは①であることを証明するのは難しいでしょう。
そしてそもそも②もありません。
ちなみに発明では、②の法律はあります（特許法）。
審査によって最初であるかどうかが判断されます。
■（２）料理レシピは著作権で保護される？
レシピの文章や写真などには著作権が発生します。
著作権とは、ざっくり言えば「コピペ禁止」です。
この点で、レシピの文章や写真などは、著作権で保護されます。
■（３）AIなら大問題！その責任の所在は？
クックパッドの新機能が、料理レシピのコピペだったら問題です。
また、AIで料理レシピをコピペしている場合はさらに問題です。
ここで重要なのは、AI事業者も著作権侵害であるということです。
ただ実際は、AIにはいくつかの本質的な問題があり、
✓AIは著作権侵害を回避するのは得意（コピペを超える改変により）
✓料理レシピのサイトのアクセス数が減っても、AIの性質上仕方ない
そこで、クックパッドは、料理レシピをまとめるとしても、
✓料理レシピのサイトへのリンク集を作る
Googleの検索結果のようにこれくらいがいいのではないでしょうか？
これでレシピ考案者への利益還元にもつながるはずです。
