(Q) Is there a charge for determining whether my idea is patentable?
(A) Determining "patentability" involves two distinct assessments:
(1) Determining whether the idea is eligible for a patent
(2) Determining whether a patent is likely to be granted
■ (1) Determining eligibility for a patent
At our patent firm, we do not charge a fee for this assessment.
We can make this determination immediately based on the expertise of our patent examiners and patent attorneys.
■ (2) Determining the likelihood of a patent being granted
This assessment requires a "patent search."
We search to see if identical or similar patents already exist.
Furthermore, it requires an assessment—similar to that of a patent examiner—of whether the idea is "similar" to existing ones.
There is a fee for this assessment.
Based on the patent search, we also provide advice on how to improve the idea's patentability.
Please note that, regarding ideas, there is also the option of a "utility model" in addition to a patent.
We perform the same two assessments for utility models as well.
However, the nature of these assessments differs slightly from those for patents.
We will discuss this point in a separate article.
