Do you need a highly sophisticated invention to get a patent? [Revised Version]
(Q) My invention isn't exactly what you'd call technically sophisticated.
Do I need a highly sophisticated invention to obtain a patent?
(A) You don't really need to worry about the concept of "sophistication."
If the term "sophisticated" holds any meaning in this context, it is as follows:
<Ultra-Summary>
A "sophisticated invention" does not mean it is "technically advanced."
If you want to focus on anything, focus on whether it is "not easily conceived."
The following explanation prioritizes clarity over strict legal precision.
<Explanation>
The Patent Act contains a definition of an invention:
"An invention is the creation of technical ideas utilizing the laws of nature that is of a high level."
However:
✓ The Patent Act does not explicitly define what constitutes a "high level" (sophistication).
✓ The wording could even be interpreted to mean that *any* invention is, by definition, of a "high level."
✓ Whether or not an invention is considered "sophisticated" does not affect the outcome of the patent examination.
So, you can safely ignore the "sophistication" requirement (haha).
A concept often confused with "sophistication" is an invention's "inventive step" (or non-obviousness).
I will explain this below without using the difficult term "inventive step."
■ Having an inventive step = Being original
I wrote in another article about what kind of inventions qualify for a patent.
The two conditions are:
✔ The invention is clear.
✔ The invention is original.
"Being sophisticated (technically advanced)" is not listed as a condition.
This concept of "originality" means roughly the same thing as it does in everyday conversation.
In other words:
① Something already known to the world → Not original
② Something almost identical to what is already known to the world → Not original
An invention falling under category ① is said to lack "novelty."
An invention falling under category ② is said to lack an "inventive step."
The "almost identical" aspect of category ② is judged based on the question: "Could this be easily conceived?"
This judgment is considered one of the most difficult determinations in the world of patents. (I will omit the details of this assessment here.)
I trust you understand that this does not necessarily imply "advanced technology."
■ It Can Lead to "Advanced Technology" as a Result
This article is not suggesting that you should seek a patent for absolutely everything.
The point is that you can aim for a patent without specifically focusing on "advanced technology."
"Advanced technology" may well be more useful to society in many cases.
However, that is a matter of hindsight—a result rather than a prerequisite.
In other words:
✓ Patents are granted for many inventions—some of which are likely technically advanced.
✓ Patented inventions are applied or combined with others.
→ This can, as a result, lead to advanced technology.
■ The Desire to Obtain a Patent Is What Matters
The most important thing is simply wanting to obtain a patent.
Your reasons for doing so could include:
✔ Wanting to prevent others from imitating your invention
✔ Wanting to highlight the originality of your invention
✔ Wanting to boost your brand strength by obtaining a patent
...and so on.
"It’s not advanced technology—can I really get a patent?"
There is no need to worry about things like that.
