<目次>

The "Flip Side" of Demands to Disclose Generative AI Training Data

"No Penalties for AI Companies Regarding Disclosure of Training Data or Requests from Rights Holders"

I saw news reports about this government proposal.

In this article, I offer an explanation from the perspective of a patent attorney specializing in intellectual property, including copyright law.

I will discuss this from the standpoint of protecting creators.

It might turn into a bit of a "behind-the-scenes" or "dark side" kind of commentary (haha).

<Table of Contents>

(1) Can we regulate "training" by AI companies?

(2) Even if "training" is copyright-compliant, "generation" might still be a violation

(3) If an AI company commits copyright infringement, a lawsuit is possible without a prior disclosure request

■ (1) Can we regulate "training" by AI companies?

Regarding the news mentioned earlier, there were comments from AI proponents like this:

"Training isn't illegal! The government is out of touch with the times!"

It is true that training itself is not illegal.

However, is generative AI truly significant enough to warrant calling the government "out of touch"?

Since the act itself isn't illegal, the decision to forgo penalties is somewhat understandable.

That said, measures like disclosure requests represent a step forward in protecting creators.

Moving forward, we must also keep a close watch for issues such as the following.

■ (2) Even if "training" is copyright-compliant, "generation" might still be a violation

AI companies cooperating with the disclosure of training data or responding to requests from rights holders!

At first glance, this seems like a good thing.

However, there is a risk of the opposite: the idea that "since we cooperated on training transparency, anything goes for generation!"

It would be a major problem if AI companies were allowed to interpret the rules that way.

Even if the training process complies with copyright law, the resulting AI-generated content can certainly still constitute copyright infringement.

■ (3) If an AI company commits copyright infringement, a lawsuit is possible without a prior disclosure request

Furthermore, if the generated content infringes on copyright, the creator can sue directly.

Under the current proposal, there is no requirement that one *must* make a disclosure request first.

■ Is AI writing the news about AI?

The news reports in question did not touch upon the issues raised in (2) and (3) above. I would like to see major media outlets report on this in greater depth.

Or perhaps AI-generated articles are actually being written by AI?

On this blog, experts provide candid commentary without relying on AI!
