発明を発表しても特許出願は急がなくて大丈夫?【リライト版】

(Q)特許を出願する前に、商品をネット上で発表してしまいました。
1年以内に出願をすれば、特許を取れることがあると聞きました(★)
1年もあるので、そんなに急がなくても大丈夫ですよね?

(A)急いで特許出願した方が、賢明です。
この場合の「1年以内に出願すれば」はあくまで例外です。
この1年の間における他者の行動によっては、デメリットがあります。
特許を取れなかったり、特許を取るのに苦労するおそれがあります。

上記の「1年以内に出願すれば」は、新規性喪失の例外と言います。
発明の新規性を喪失しても、1年以内に所定の手続きができます。
その新規性を喪失した行為がなかったものとみなされます。

ここで重要なのは、その新規性を喪失した行為「以外」の行為です。

例えば、他者が、同じ発明を発表した場合です。
その行為によって、その発明の新規性を喪失することがあります。

より極端な例としては、他者が同じ発明を特許出願した場合です。
他者に特許を取られてしまうおそれがあります(かつ1年以内に)。

このような場合に、その他者の発表や特許出願に対して、
「自分が発表した発明を盗んだものだ」
と主張できるでしょうか?

事実はどうあれ、この主張を立証するのは極めて困難と思われます。

さらにこの話、「1年」という期間は、本質的な点ではありません。
例えば「3日」だとしても同様の問題があります。

結論としては、商品を発表したら、一刻も早く特許出願すべきです。

本記事を書いたきっかけはある大学教授の発言がきっかけです。
研究を発表してから、一定期間内に特許出願をすればいいんです!
そういう趣旨のことをYouTubeでおっしゃっていました。

この大学教授の発言の是非を問うつもりはありません。
(最先端技術などでは、実務上はそういう考え方もあるでしょう。)
その大学教授は、特許に関しては必ずしも専門ではないのでしょう。

特許はたしかに難解です。
しかし、難解のままでよいはずがありません。

産業の発達のための特許制度です。
そんな特許制度がかえって産業の発達の足かせになってはいけません。
特許のことを周知していくことが大事だとあらためて感じました。
私たち専門家(弁理士)や特許庁など関係者の責務です。

ここでは参考までに、一つの事例を挙げました。
この事例を一般化して考える際には、十分にお気を付けください。
発明(商品)を発表してしまった後に、特許を目指したい!
そんな場合はできるだけお早めに、弁理士に相談してください。

You can't get a patent for a product after you've already started selling it, right?

The "filing within one year" rule mentioned above is known as the "exception to loss of novelty."

Even if the invention loses its novelty, you can follow specific procedures within one year.

The act that caused the loss of novelty is then treated as if it never happened.

What is crucial here, however, are actions *other* than the one that caused the loss of novelty.

For example, consider a situation where someone else announces the same invention.

That action could cause the invention to lose its novelty.

An even more extreme example is if someone else files a patent application for the same invention.

There is a risk that the other person could obtain the patent (even within that one-year window).

In such a case, could you argue against the other person's announcement or patent application by claiming,

"They stole the invention I announced"?

Regardless of the facts, substantiating such a claim would likely be extremely difficult.

Furthermore, the specific duration of "one year" is not the essential point here.

The same problem would exist even if the timeframe were, say, "three days."

In conclusion, once you announce a product, you should file a patent application as soon as possible.

This article was inspired by a statement made by a university professor.

"You just need to file the patent application within a certain period after announcing your research!"

That was the gist of what they said on YouTube. I do not intend to pass judgment on the merits of the university professor's remarks.

(In fields involving cutting-edge technology, such a perspective may well be valid from a practical standpoint.)

It seems likely that the professor is not necessarily a specialist in the field of patents.

Patents are certainly complex.

However, there is no reason for them to remain so difficult to understand.

The patent system exists to foster industrial development.

It must not become a hindrance to that very development.

This situation has reinforced my belief in the importance of raising awareness about patents.

It is the responsibility of professionals like us—patent attorneys—as well as the Japan Patent Office and other stakeholders.

I have cited this case study merely for reference.

Please exercise caution if you attempt to generalize from this example.

If you wish to obtain a patent after having already publicly disclosed your invention (or product),

please consult a patent attorney as soon as possible.
