<解説>

特許発明A  = a+b+c
今回の発明B = a+b

特許発明A(a+b+c)も、aとbを含んでいます。

Two Points to Consider When Seeking a Patent for an Invention with Some Elements Removed [Revised Version]

(Q) I obtained a patent for a certain invention (let's call it Invention A).

The patent gazette has already been published.

Invention A consists of three constituent elements (let's call them a, b, and c).

I discovered that removing element "c" results in a better product.

Can I obtain a patent for this idea?

(A) While it is likely quite difficult, there is a possibility of obtaining a patent.

You need to be careful about how you draft the patent application documents.

<Explanation>

Let's call the questioner's invention "Invention B."

Since Invention B involves removing element "c," it consists of two constituent elements (a and b).

Patented Invention A = a + b + c

Current Invention B = a + b

"Removing element c" is an idea in itself.

✓ If no one has implemented this idea before (novelty exists), and

✓ If the difference from conventional technology is significant (inventive step exists),

then there is a possibility of obtaining a patent.

Is the difference between the current Invention B and the (conventional) patented Invention A significant?

It is certainly a subtle point, but the possibility of obtaining a patent is not zero.

■ How to Draft Patent Application Documents

However, you must be careful about how you draft the application documents.

If you state the following in the scope of the patent claims:

"Invention B consists of a and b,"

you likely will not be able to obtain a patent.

Generally, a statement saying "consists of a and b" implies that:

✓ a and b are "essential" elements, while any other elements are optional.

In other words, it means it consists of "at least" a and b.

Patented Invention A (a + b + c) also includes a and b.

Consequently, Invention B would appear to have no difference from patented Invention A.

So, how should it be described?

Let's consider a few options below. ① "Invention B consists solely of a and b."

Restrictive expressions like "solely" (or "only") are not commonly used.

However, in this specific case, phrasing it this way is one option.

② "Invention B consists of a and b and does not include c."

Negative expressions like "does not include" are also rarely used.

However, to clarify the nature of the invention, this type of wording is worth considering.

Regarding ①, however, you must be careful: does it truly consist *only* of a and b?

While stating "solely" is certainly effective for excluding c,

it also excludes everything else as well.

Regarding ②, you should also pay attention to the relationship between Invention B and c.

Phrasing it as "Invention B... does not include c" might raise the question: "Where did c come from?"

It can sometimes feel a bit abrupt.

■ The Ideal Approach

The best method is to express the exclusion of c *indirectly*, as shown below in ③.

There are cases where Invention B does not include c but *does* include another component (d)—

for instance, to ensure that the inclusion of c is unnecessary.

In this scenario, Invention B can be described as "consisting of a, b, and d."

You can then include a statement in the application documents such as:

"Since Invention B includes d, there is no need to include c; this results in a superior invention."

This approach is the most effective, as it allows you to explain the exclusion of c indirectly.
