個人情報を守るのは個人情報保護法の目的か?手段か?
個人情報保護法の目的は、
個人を保護するのが目的で、個人情報の保護はそのための手段です。
優劣を付けるなら、個人の保護≫個人情報の保護(当然ですが)
では、あまりに形式的に個人情報を保護するとどうなるか?
個人情報の保護の範囲が広くなり過ぎることがあります。
個人の保護を超えるものまで保護することもあるでしょう。
その場合、手段と目的が逆転してしまいます(手段の目的化)。
健康のためたら死んでもいいみたいな感じですね(笑)
そこで、
✓①形式的に保護している個人情報
✓②個人を保護するために保護する必要性が薄い個人情報
①から②を除外することは法目的にも反しません。
今回の規制緩和はこのようなことなのでしょう。
ロビイストが一役買っていたかはわかりません。
■個人は心配しなくて大丈夫。医師は・・・
繰り返しますが、あくまで個人の保護が優先です。
この部分が緩和されたら、違法状態になります。
この点は心配しなくて大丈夫です。
よく心配される個人情報として、病歴があります。
個人と結びついた病歴が漏れる?といった心配はしなくて大丈夫です。
この点で心配すべきなのは、むしろ医師の方かも知れませんね。
下手に統計データなど取られたらどう影響するか?
医師会が今回の規制緩和をどう考えているのかが気になります。

Is protecting personal information the *goal* of the Act on the Protection of Personal Information, or merely a *means*?
"Who is the Act on the Protection of Personal Information for? Asking the lobbyists who sought deregulation."
I came across a news article with a headline like that—an article related to AI.
It has a somewhat conspiracy-theory vibe; major newspapers really will publish anything these days, won't they?
My blog's basic stance is:
✓ I am strongly opposed to generative AI that disregards creators!
However, that online article has a rather questionable title.
So, for a change, I’m going to discuss the legitimacy of training generative AI.
I also want to reassure you that there is no risk of harm to individual protection.
■ Is protecting personal information the goal of the Act on the Protection of Personal Information, or merely a means?
The purpose of the Act on the Protection of Personal Information is:
✓ To utilize useful information while protecting the rights and interests of individuals (Article 1).
Protecting the individual is the goal; protecting personal information is the means to achieve that.
If we were to rank them, protecting the individual > protecting personal information (naturally).
So, what happens if we protect personal information too rigidly?
The scope of protection for personal information can become overly broad.
It might end up protecting things that go beyond the actual need to protect the individual.
In that case, the means and the end get reversed (treating the means as the goal).
It’s like saying you’re willing to die for the sake of your health (lol).
Therefore:
✓ ① Personal information currently protected as a matter of form
✓ ② Personal information where the need for protection is low regarding the protection of the individual
Excluding ② from ① does not conflict with the purpose of the law.
That seems to be what this deregulation is about.
I don't know if lobbyists played a role in it, though.
■ Individuals don't need to worry. Doctors, on the other hand...
To reiterate, protecting the individual takes priority.
If that aspect were relaxed, it would result in an illegal situation.
You don't need to worry about that point.
Medical history is a common concern regarding personal information.
But you don't need to worry about medical history linked to you personally being leaked.
In this regard, it might actually be the doctors who should be worried.
What kind of impact would there be if statistical data were collected carelessly? I am curious to know what the Medical Association thinks about this round of deregulation.
