Discussions about trademarks often heat up online.

Discussions often proceed based on this premise.
However, many of these arguments appear hollow because that premise is flawed.
In this article, I will explore effective ways to utilize trademarks.
I intend to prioritize clarity over strict legal precision.
■ Reconfirming the Meaning of Trademark "Use"
First, let’s clarify what constitutes the "use" of a trademark.
✔ ① "Use" (*shiyō*) is a specific legal term defined in the Trademark Act (Article 2).
✔ ② Simply writing or speaking the text of a trademark does *not* constitute "use" in the legal sense.
Therefore, in this article, I will refer to ① as "Use" (legal sense) and ② as "using" (general sense).
■ A Professional’s View on Appropriate Trademark Utilization
Consider the relationships between three parties: the trademark, the trademark owner (right holder), and the consumer.
[Consumer] ←①→ [Trademark] ←②→ [Trademark Owner]
① Relationship between the consumer and the trademark
It is crucial for the trademark to be recognized by a large number of consumers.
② Relationship between the trademark and the trademark owner
The connection between the trademark and the owner is crucial.
Trademark owners might be tempted to focus solely on ②.
However, neglecting ① renders the trademark meaningless.
If consumers do not recognize the trademark, it cannot fulfill its function.
A trademark is not about monopolizing "words" or "expressions."
For the sake of the trademark owner, the trademark should be "used" widely by others.
It is better for the trademark to be recognized.
■ An Unfortunate Way to Utilize Trademarks
When a trademark owner tells consumers "Do not use" the trademark!
Regarding ①, this is the most unfortunate way to utilize a trademark. As mentioned above, failing to allow the trademark to be recognized is problematic.
After all, there is no legal basis for demanding that others "not use" it.
Such a demand could even potentially constitute the crime of coercion.
However, completely ignoring how consumers "use" the trademark is also risky.
If the link to the trademark is severed (i.e., if it loses its association with the source), it risks becoming a "generic term."
It could lose its function as a trademark altogether.
■ How to utilize the trademark while balancing ① and ②
Ideally, you want to balance ① and ②.
How can this be achieved?
You should allow consumers to "use" the trademark in a natural way.
For example, let them "use" it in blogs or on YouTube.
(To reiterate, however, "use" *as* a trademark—implying it is their own brand—is not permitted.)
In doing so, you might encourage them to include a statement such as:
"This is a registered trademark of [Name/Company]."
Those who "use" the trademark should also proactively include such statements.
Looking around, many registered trademarks are utilized in this manner.
This is just one perspective, but I hope it proves helpful.
