If the AI's training data is copyright-compliant, is the generated output also copyright-compliant?
"Generate images without worrying about copyright—generative AI you can use with peace of mind."
You often see advertisements making claims like this for generative AI lately.
"What if an AI-generated illustration happens to look exactly like an existing character?"
Some people raise questions like this.
Ultimately, it all boils down to this point:
✓ If the AI's training data is copyright-compliant, is the generated output also copyright-compliant?
Let’s consider this issue from the perspective of protecting creators.
<Table of Contents>
(1) Examples that are clearly impermissible and examples that are safe
(2) Examples in the "gray zone" that border on impermissible
■ (1) Examples that are clearly impermissible and examples that are safe
① Training on existing copyrighted works without proper authorization → Generating them as-is
② Training on works with no copyright issues → Generating them as-is
It is obvious to anyone that ① is impermissible while ② is safe.
Regarding ①, a major film production company has described it as "textbook copyright infringement."
The AI operator is committing copyright infringement, and anyone who publishes the generated output shares the same liability.
However, the question remains: is this even "AI" in the first place?
■ (2) Examples in the "gray zone" that border on impermissible
Controversy arises regarding AI when the training data differs from the generated output.
✓ The AI has not been trained on a specific copyrighted work (Work X)
✓ The AI generates Work X through some form of calculation
This case should also generally be considered impermissible.
The reasons are:
✓ Copyright law exists to protect creators
✓ The concept of "reliance" (or "access") in copyright law assumes human creative activity
✓ The "calculation process" could be exploited
Let’s assume, for the sake of argument, that we don't immediately label it copyright infringement.
Suppose we merely "presume" infringement but allow room for rebuttal.
We might say it is safe if the AI can prove it was not trained on Work X.
Even in that scenario, proving a lack of training would be virtually impossible. In this respect, it falls into a "gray area" that is virtually indistinguishable from "black" (impermissible).
What are your thoughts?
There is likely not yet a substantial body of case law regarding AI-related copyright infringement.
In that sense, anything that isn't clearly "out" (illegal) or "safe" (legal) can be considered a gray area.
Will the day ever come when we can use such generative AI in business with complete peace of mind?
