発明の名称について~特許証に載ることと権利との関係【リライト版】
「発明の名称」は、特許証にも掲載されます。
発明者としては、とても意味のある項目です。
★実用新案についても同様です。
発明者としては、自分の発明に、思い入れのある名称にしたいですね。
「ぴょんぴょんシューズ」
「<発明者の名前>シューズ」
「ヒーローシューズ」
などを発明の名称にしたいと思うかも知れません。
特許の権利範囲を定めるのは「特許請求の範囲」という書類です。
その中に「請求項」という項目があります。

ただ審査において、そのことが審査官から指摘されることがあります。
その記載が権利内容を決めることになります。
極端な例で、請求項の末尾を「ヒーローシューズ」にしたとします。
ヒーローが使わないシューズは、その権利に含まれない!
そう解釈されるおそれがあります。
「発明の名称」で一番多かったのは、「撮像装置」です。
「撮像装置」と言われても、どんなアイデアか全然わかりません。
もちろん、「撮像装置(カメラ)自体」を発明したわけではありません。
ある特徴を有する撮像装置の発明です。
親しくしていたある審査官が、そうおっしゃっていました。
アメリカの特許では、発明の名称に、発明の特徴が記載されている!
(発明の特徴=作用・効果など)そんな特許が多いように思います。
弁理士の権利に対する考え方も重要です。
✓発明者(依頼者)がいくつか提案して、弁理士に選んでもらう
✓あるいは、この逆がいいのではないかと思います。
特許の権利的には最も無難と言えるでしょう。

The "Title of the Invention" is listed on the patent certificate.
For an inventor, this is a highly significant item.
This information can also serve as a useful reference when you engage a patent attorney to handle patent procedures.

■ The Inventor's Perspective
When a patent is granted, the "Title of the Invention" appears on the patent certificate.
Naturally, an inventor wants to give their invention a name that holds personal meaning.
For instance, if the invention is a shoe that allows the wearer to jump,
you might want to name it something like:
"Boing-Boing Shoes"
"[Inventor's Name] Shoes"
"Hero Shoes"
■ The Patent Attorney's Perspective
On the other hand, a patent attorney aims to select a title that is optimal for the patent as a legal document defining rights.
The scope of patent rights is determined by a document called the "Claims."
Within that document, there are specific items known as "claims."
The "Title of the Invention" is often made to match the wording at the *end* of the claim.
For example, with the jumping shoe invention:
[Claims]
[Claim 1] ... A shoe comprising a spring (for jumping).
It would be written like this.
In this case, the title of the invention is often simply "Shoe."
The "Title of the Invention" does not necessarily have to describe the invention's specific "features."

<Reference> Various points regarding the "Title of the Invention"
・It is not a problem if the title of the invention does not match the end of the claim.
However, an examiner might point this out during the examination process.
・The wording at the end of the claim is, after all, part of the claim itself.
That wording determines the content of the rights.
To take an extreme example: suppose you named the end of the claim "Hero Shoes."
Shoes not used by a hero would not fall within the scope of those rights! There is a risk that it might be interpreted that way.
・During my time as a patent examiner, I examined applications in the camera field.
The most common "Title of the Invention" was simply "Imaging Apparatus."
However, the term "Imaging Apparatus" gives no clue as to the actual nature of the idea.
Of course, the invention was not the "imaging apparatus (camera) itself."
It was an invention concerning an imaging apparatus with specific characteristics.
・Compared to the U.S., Japanese titles of inventions are hard to understand!
A fellow examiner I was close with used to say this.
In U.S. patents, the title often includes the invention's specific characteristics!
(By characteristics, I mean things like its function or effects.)

■ So, how should the title of the invention be determined?
The inventor's own preferences are important.
The patent attorney's perspective on patent rights is also crucial.
Therefore, when it is necessary to align these views, for example:
✓ The inventor (client) could propose a few options for the patent attorney to choose from,
✓ Or, the reverse approach might be better.
Of course, simply adopting the title proposed by the patent attorney is also an option.
From the standpoint of patent rights, that is arguably the safest choice.
