お客様の発明について特許調査を行う目的は主に次の２つです。
①その発明で特許が取れるか？
②その発明を実施した場合に、他者の特許の侵害にならないか？
特許調査はそれだけでも私どもの一つのサービスです。
元特許審査官の知見を生かした高度な特許調査を行います。
特許調査のみで終わりになることもあります。
例えば、①で特許を取るのが難しいとわかることもあります。
②でこのままだと侵害になるので、製品を変えることもあります。
一方、特許出願を行う場合は、特許出願のみではありません。
必ず、特許調査も行います。①の調査です。
むしろ②は、①の調査の結果のオマケのようなものです。
■（２）特許調査の費用が特許出願の費用ほど掛からない理由とは？
上記をまとめると、
✓(a)特許調査が目的の場合
特許調査のみ行います。
✓(b)特許出願が目的の場合
特許調査を行ったうえで、特許出願を行います。
弊所の費用は(b)を中心にしています。
特許調査の費用は10万円（税別）です。
特許出願の費用は25万円（税別）です（他に特許印紙代が必要）。
特許調査の費用が、特許出願の費用ほど掛からない理由・・・
これは結果的にそうなっているだけです。
敢えていうなら、特許調査は着手金のように捉えて頂いて構いません。
お客様の状況によっては、特許調査の費用対効果は非常に高いです。

However, patent searches and patent applications are not really things that should be compared directly against each other.
We explain this distinction below.

■ (1) The relationship between patent searches and patent applications
There are two main objectives when conducting a patent search for a client's invention:
① Can a patent be obtained for the invention?
② If the invention is implemented, would it infringe upon someone else's patent?
A patent search stands as a distinct service we offer.
We conduct high-level patent searches leveraging the expertise of former patent examiners.
Sometimes, the process concludes with just the patent search.
For instance, the search might reveal that obtaining a patent (objective ①) is difficult.
Or, regarding objective ②, it might show that proceeding as-is would result in infringement, leading the client to modify the product.
On the other hand, a patent application process involves more than just the application itself.
We always conduct a patent search—specifically, the search for objective ①—as part of the process.
In fact, the check for objective ② is essentially an added benefit derived from the results of the search for objective ①.
■ (2) Why do patent searches cost less than patent applications?
To summarize the above:
✓ (a) When the objective is a patent search
We conduct only the patent search.
✓ (b) When the objective is a patent application
We conduct a patent search and then proceed with the patent application.
Our firm's pricing structure is centered on scenario (b).
The cost for a patent search is 100,000 yen (excluding tax). The fee for a patent application is 250,000 yen (excluding tax); please note that separate patent office official fees (for revenue stamps) also apply.
Regarding why the cost of a patent search is lower than that of the patent application itself...
This is simply how the pricing works out in practice.
If one were to characterize it, you might view the patent search fee as an initial retainer.
Depending on your specific situation, the cost-effectiveness of a patent search can be extremely high.
