声の権利侵害で『NO MORE 無断生成AI』声だけの問題か？
声優などの「声」を生成AIから守ろう！
そんな話題が増えました。訴訟にも発展していますね。
社会全体で考えるべき問題だという訴えです。
そこで著作権など知的財産権の専門家として意見を書いてみます。
ちなみに私は「声」にもかなりうるさい（笑）（末尾のリンク参照）

■（１）声を生成AIから守る２つの条件
声を守るといっても、なんでもかんでも守れるわけではありません。
声を生成AIから守るには、次の２つの条件が必要と考えます。
①その似ている声が、本人との関係で使われている
②親告罪（声優などからの訴えが必要）
例えば、似ている声が動画中で使われていたとします。
その動画中に、その人の名前やイラストなどが無断で使われている！
これはアウトとすべきでしょうね（①）
なんなら、声はそこまで似ていなくてもアウトにすべきです。
またこの行為は、生成AIではなく人のモノマネでもアウトです。
その動画を不快に思う本人が、訴えることができるとします（②）
■（２）『NO MORE 無断生成AI』は声だけの問題ではない！？
上記の動画は、不正競争防止法や民法（詐欺罪等）でも規制できます。
さらに生成AIの場合は、①を満たさなくてもアウトにしてもいいです。
つまり、似ている声の存在が不快というだけでアウトとします。
✓生成AIの場合は、無限に生成できるので、声が広まることが不快
✓動画制作者は、悪意がないのなら簡単に声を変更できるはず
結局のところ、生成AIの問題の本質は「無限に生成」の部分です。
いわゆる「市場の希釈化」の問題が生じます。
類似の生成物が無限にできることで、本家が市場に埋もれる現象です。
そして、著作権上は問題を問えない。
この問題は「声」だけの問題ではありません。
このように見てくると、生成AIが本当に世の中に必要なのか？
社会全体で考えるなら、ここまで踏み込んでもいいはずです。
生成AIには著作権侵害・情報漏洩・犯罪利用など問題が山積みです。
科学技術の発展に重要なのは「フィジカルAI」の領域でしょう。
これらをまとめてAIの発展と称することに大きな違和感があります。
最後は社会問題にまで踏み込んでみましたが、いかがでしょうか？

■ (1) Two Conditions for Protecting Voices from AI Generators
Protecting voices isn't about protecting them indiscriminately.
We believe the following two conditions are necessary to protect voices from AI generators:
① The similar voice is used in relation to the person in question.
② It's a crime that requires a complaint from the victim (a complaint from the voice actor, etc.)
For example, suppose a similar voice is used in a video.
If the video also uses the person's name or illustration without permission,
This should be considered unacceptable (①).
In fact, it should be considered unacceptable even if the voice isn't that similar.
This also applies to human impersonation, not just AI generators.
Assume that the person who finds the video offensive can file a lawsuit (②).

The realm of "physical AI" is crucial for the advancement of science and technology.
There's a strong sense of unease in calling all of these together the development of AI.
