特許製品と類似の物が他社から販売されているのはなぜ？【リライト版】
ただ他社からも同じようなものが販売されています。なぜでしょうか？
正当な権限のない他社が、特許発明を製造販売することはできません。
逆に言えば、
✓「正当な権限」があるか、「特許発明」でなければ、
製造販売できます。
その場合には、その特許発明を製造販売できます。
例えば、炊飯器のうち特殊なロックの部分にのみ特許があるとします。
他社は、ロックの部分が異なる炊飯器であれば製造販売できます。
その他の部分が類似していても製造販売できます。
