Is the US ruling allowing AI to learn without permission truly "shocking"?

I came across a news article with the title, "The 'Shocking' US Ruling Allowing AI to Learn Without Permission: What Will Become an Impact on Companies and Rights Holders?" It was from a major newspaper.

It seems to be an older article, but it's worth revisiting now.

Those familiar with Japanese copyright law might wonder, "What's so shocking about this?"

It would be shocking if it meant that AI generation became unrestricted.

Let's review these points.

<Table of Contents>

(1) Proving that AI learned without permission is difficult

(2) Copyright infringement with AI-generated content is illegal

(3) Strengthening AI regulations would be "shocking"

■(1) Proving that AI learned without permission is difficult

In Japan, AI learning is generally not a problem.

This is because AI learning does not harm the protection of creators.

Incidentally, let's assume that AI learning is illegal.

Even in that case, proving that the AI learned would be difficult.

In this respect, regulating unauthorized learning by AI is not realistic.

■ (2) Copyright Infringement with AI-Generated Works is Unacceptable

If an AI generates something identical to a copyrighted work, wouldn't that prove it learned?

Some people may have this question.

However, even before considering proof of learning, the generation itself is unacceptable.

In this respect, the protection of creators is not harmed.

So, what happens if something similar to a copyrighted work is generated?

① Substantially identical to the copyrighted work → Copyright infringement

② Not identical to the copyrighted work → Creator's interests are not harmed

■ (3) A "Shock" if AI Regulations are Strengthened

Something in between ① and ② is troublesome.

The so-called "market dilution" problem arises.

Each AI-generated work does not infringe copyright, but the problem is that they are generated infinitely.

This is the problem of copyrighted works being buried in the market by AI-generated works.

If this were to be regulated, it would be considered a "shock."

Rather than shock, perhaps it's more of a "joy" for creators?

On the contrary, the media is the one most affected by the problem of market dilution...

The reporting stance and copyright knowledge of major newspapers' AI are quite shocking!
