AIを発明者として特許が取れるか？覚えたら忘れない考え方３つ
こんなニュース記事を見ました。

■AIを発明者として特許が取れるか？覚えたら忘れない考え方３つ
①特許は人間のためにある！
②AIを発明者（特許権者）にしてなんのメリットがある？
③AIでその発明を生成したなら、その発明で特許は取れない！
特許は人間のためにあるものです！
そう言ったら身も蓋もないですが、そう覚えたら忘れませんね。
（著作権や意匠権なども同じように考えることができます。）
ちなみに、人間以外で発明をするという点では・・・
AIよりむしろ動物や植物のほうが自律的に発明できそうに感じます。
■②AIを発明者（特許権者）にしてなんのメリットがある？
仮にAIを使って、発明のようなものが生成できたとします。
それならAIを使っていた人がその発明で特許を目指せばいいのでは？
なぜAIと特許をシェアしようとするのかわかりません。
この②は覚えて忘れないために書きました。
実際は、AIの生成物では特許は取れません。次の③をどうぞ。
■③AIでその発明を生成したなら、その発明で特許は取れない！
仮にAIを使って、発明のようなものが生成できたとします。
この場合、その発明は新規性がなく、特許は取れません。
つまり、AIを発明者として記載したら、特許が取れなくなるだけです。
AIの生成物が世の中の情報の組み合わせだからいうこともあります。
より問題なのは、
✓だれでも同じプロンプトを入れたら、同じ生成物になり得る
だれでも見得る状態にあると言え、この生成物は新規性がありません。
だれも思いつかないプロンプトだから、発明を生成できた？
それならやはり、そのプロンプトを入れた人が発明者です。
（そして、AIに入れたことで、発明の新規性を自ら喪失している）

Patents are for humans!
That may sound like a cliché, but once you remember it, you'll remember it.
(Copyrights and design rights can also be thought of in the same way.)
By the way, when it comes to non-human inventions...
It seems more likely that animals and plants are more capable of autonomously inventing than AI.
■②What is the benefit of having AI as the inventor (patent holder)?
Let's say that AI is able to generate something resembling an invention.
In that case, wouldn't the person using the AI just try to patent that invention?
I don't understand why anyone would try to share a patent with AI.
I wrote this ② so that you don't forget.
In reality, AI products cannot be patented. Please see ③ below.
■③If the invention is generated by AI, it cannot be patented!
Let's say that AI is able to generate something resembling an invention.
In this case, the invention will lack novelty and will not be patentable.
In other words, listing AI as the inventor would simply make it impossible to obtain a patent.
This is also because AI products are a combination of information from the world.
The bigger problem is that
✓If anyone enters the same prompt, the same result can be produced.
While this result is visible to anyone, it lacks novelty.
Was the invention generated because the prompt was something no one had thought of?
If that's the case, then the person who entered the prompt is the inventor.
(And by putting it into an AI, they themselves lost the novelty of the invention.)
