Is a Tweet a Copyrighted Work? Is it a Copyright Infringement? A Simple Way to Determine
Social Media Users Shocked by Ruling That "Tweets are Copyrighted Works"!
A Lawyer Points Out "It's Just a Thing"!
I saw a news article with the following content.
News article titles tend to be exaggerated.
This "it's just a thing" is wrong. Are they trying to disparage lawyers? (lol)
So, as a patent attorney (not a lawyer), I'll explain.
■Is a Tweet a Copyrighted Work? A Simple Way to Determine Copyright Infringement
① Is it a Copyrighted Work?
First, determine whether it's a copyrighted work.
In short, was it something the tweeter created?
More casually, was it something they thought about when they wrote it?
If so, it's a copyrighted work.
For example, a simple greeting, a list of facts, a cliché, etc.
These don't feel like they were thought about when they wrote it.
Therefore, they're not copyrighted works.
When I say "it's just a thing," I don't mean it has to be sophisticated.
Also, length doesn't matter. For example, a haiku is a copyrighted work even if it's only 17 characters long.
What percentage of tweets are actually copyrighted works?
I'll look into that next time.
② Is it copyright infringement?
So, under what circumstances does it constitute copyright infringement?
Let's think about this simply:
✓You wouldn't want someone to copy and paste something you've thoughtfully tweeted, right?
Copyright is the right to copy.
Copyright infringement occurs when someone copies something you thoughtfully tweeted without permission.
What if something you thoughtfully wrote just happens to be the same as someone else's copyrighted work?
In this case, it wouldn't be copyright infringement (search for "relative exclusivity" for more details).
However, this idea shouldn't be stretched too far.
✓It would be nice if it were spread around! So copying and pasting it isn't copyright infringement!
If you can determine that something is a copyrighted work in ①, the general rule is not to copy and paste it.
③ What about quoting?
Quoting is a common problem with X.
Quotations are certainly copied and pasted.
However, sometimes you just need to copy and paste the bare minimum to make a tweet!
In such cases, it's permitted.
This only applies if the tweet is the main focus and the quoted content is secondary.

This article is a simple guide to deepening your understanding of copyright.
We've prioritized clarity over precision.
Ideally, you should be familiar with copyright law and use the above approach if you're unsure.
If copyright law is difficult, try thinking about it above first.
