AIで顔を無断合成した画像を拡散したらどういう処分になるか？
こんな内容のニュース記事を見ました。
弁護士ということですが、少なくともこのタイトルは間違っています。
おそらくAIで書いた記事か？弁護士を貶めたいのか？（笑）
そこで弁理士（弁護士じゃないですよ）として解説してみます。
私たち弁理士の専門でもある知的財産権にも関係する内容です。
■AIで顔を無断合成した画像を拡散したらどういう処分になるか？
さっそく結論ですが、以下の法律で対応できます。処分されます。
✓①民法：精神的苦痛・名誉棄損に当たる
✓②憲法：肖像権と同様に「幸福追求権」がある
✓③著作権法：AIによる生成物について
あなたの顔が、AIに無断生成されて拡散されたらどうでしょう？
精神的に苦痛ではありませんか？
名誉棄損されたと感じませんか？
精神的苦痛・名誉棄損はよく耳にするでしょう。それと同じです。
拡散した者に対して損害賠償請求などをすることができます。
■②憲法：肖像権と同様に「幸福追求権」がある
AIによる顔の拡散は、肖像権の侵害になります。
ちなみに、肖像権法という法律はありません。
憲法の「幸福追求権」から派生する権利だと言われます。
ただそれで「既存の法律では対応できない」と言う弁護士はいません。
■③著作権法：AIによる生成物について
生成AIの著作権の問題は、学習ではなく生成です。
（最近は学習もアウトにという声が大きいですが、生成は元々アウト）
生成されて拡散される内容に著作物が含まれていたら、即アウトです。
これはディープフェイクポルノに限ったことではありません。

✓② Constitution: The Right to the Pursuit of Happiness, as well as the Right to One's Image
✓③ Copyright Law: Regarding AI-Generated Creations
■① Civil Code: Emotional Distress and Defamation
What would you do if your face were generated by an AI and spread without your permission?
Wouldn't it cause you emotional distress?
Wouldn't you feel like your image was defamatory?
You've probably heard of emotional distress and defamation before. It's the same thing.
You can sue the person who spreads the image for damages.
This point is not unique to deepfake porn.
In the case of deepfake porn, the amount of compensation will likely be greater.
■② Constitution: The Right to the Pursuit of Happiness, as well as the Right to One's Image
Distributing a face using AI is a violation of the Right to One's Image.
It goes without saying that deepfake porn violates the Right to One's Image.
By the way, there is no law called the Portrait Rights Act.
It is said that this right derives from the Constitution's "Right to the Pursuit of Happiness."
However, no lawyer would say that existing laws cannot address this issue.
In terms of the "right to pursue happiness," the maliciousness of the act is significant.
■③ Copyright Law: Regarding AI-Generated Products
The copyright issue with generative AI is not its learning, but its generation.
(Recently, there have been many calls to make learning illegal as well, but generation has always been illegal.)
If the content generated and distributed contains copyrighted material, it's immediately illegal.
This is not limited to deepfake porn.
