顔写真を勝手にイラストにする問題は著作権？肖像権？AIは？

■（１）顔写真を勝手にイラストにする問題は著作権？肖像権？
今回の件で言えば、横顔写真には、２つの守るべきものがあります。
①Ａ子さんの横顔（容姿）を勝手に利用されないこと（肖像権）
②Ｂ氏の横顔写真という創作物を勝手に複製されないこと（著作権）
Ａ子さんには肖像権が、Ｂ氏には著作権があります。
この２つがあることと、違いをきちんと覚えておきましょう。
ちなみに、肖像権には肖像権法という法律はありません。
肖像権は、憲法の幸福追求権から派生する人格権とされています。
個人的には、AIで問題となる「声」も幸福追求権で守るといい？
声の模倣を著作権で保護するのはややハードルが高いと思います。
■（２）生成AIもこの漫画家と同罪？
AIと言えば、ネットにこんな声がありました。
「漫画家は叩かれるのに、生成AIを叩く人はいない」
たしかに、本件の漫画家と、生成AIは同じことをしているようです。
生成AIには、肖像権の問題もあった！ということです。
（ここで重要なのは、著作権の問題とは別の問題ということです）
クリエーターでない方は生成AIによる著作権侵害の心配はないですね。
ただ、あなたの顔が生成AIに生成されて拡散されたらどうでしょう？
あなたのご家族や大切な人の容姿だったらどうでしょう？
悪用された場合はもちろん、単なる拡散でもイヤではないでしょうか？
