生成AIの著作権問題！大物政治家が解説+弁理士が補足

以下では弁理士の私見をお伝えします。

■（１）そこまでして生成AIを使うの？
大物政治家がそう言っているからという単純なものではありません。
一方、世の中には、生成AIのリスク回避に関する情報も多数あります。
ある情報を見てみたら、膨大な専門的知識のオンパレードでした。
リスク回避というからには、それに見合うメリットが必要です。
生成AIにそんなメリットが本当にあるでしょうか？
■（２）生成AIを他のAIと分けて考えるのもいい！
生成AIを否定する内容になりましたが、AI全般を否定はしません。
以下のものも「AI」と呼ばれますがメリットも大きいでしょう。
✓ロボット工学
✓自動化
✓個人的な使用（調べものやAiboのような使い方）
などなど
問題なのは、無節操に世の中のデータを収集する生成AIです。
AIという言葉を使っていますが上記AIとは区別してもいいくらいです。
某海外大手アニメーション制作会社は、次のように述べています。
『生成AIの著作権侵害は「意図的で恥知らず」』
言葉の使い方が秀逸でここでご紹介です＾＾；
■（３）経済など大人の事情への対処
ではなぜここまで生成AIを持ち上げるのでしょうか？
そこには、経済など大人の事情もあるのでしょうね。
（実際、株価も史上最高値だとか）
この対処としては、
✓生成AIを盛り上げるだけ盛り上げる、だけど生成AIは使わない
ビジネスにおいて、学習元が不明な生成AIを使うのは致命的です。
一方、日本企業による安全・安心な生成AIの開発がチャンスかも！
今後もAIの話題は続くでしょう。

Below is my personal opinion as a patent attorney.

■(1) Do we really need to go to such lengths to use generative AI?
It's not as simple as a leading politician saying so.
We copyright experts are also spreading awareness of the risks of generative AI.
Meanwhile, there is a wealth of information available on how to avoid the risks of generative AI.
I looked at one resource and it was a parade of vast amounts of specialized knowledge.
So, what I'm wondering is, do we really need to go to such lengths to use generative AI?
If we're talking about risk aversion, there needs to be benefits that justify it.
Do generative AI really have such benefits?
■(2) It's also good to think of generative AI separately from other AI!
This article has been critical of generative AI, but that doesn't mean I'm critical of AI in general.
The following are also called "AI" and likely have significant benefits:
✓Robotics
✓Automation
✓Personal use (research, Aibo-like use)
Etc.
The problem is generative AI that unscrupulously collects data from the world.
Although I use the term AI, it's safe to distinguish it from the AI mentioned above.
A major overseas animation production company stated the following:
"Copyright infringement by generative AI is 'intentional and shameless.'"
"Generative AI is 'textbook copyright infringement.'"
This use of language is excellent, so I'd like to introduce it here. ^^;
■(3) Dealing with Adult Issues, Such as the Economy
So why is generative AI being praised so highly?
There are likely adult issues, such as the economy, at play.
(In fact, stock prices are reportedly at an all-time high.)
To address this issue,
✓ Promote generative AI as much as possible, but don't use it.
In business, using generative AI whose learning source is unknown is fatal.
On the other hand, Japanese companies developing safe and secure generative AI may be an opportunity!
AI will likely continue to be a hot topic in the future.
This blog will also cover AI from the perspective of intellectual property rights.
