「特許」と「発明」の違い【リライト版】
いま頭に思い浮かべたとおりでほぼ間違いありません。
簡単に言うとアイデアが盛り込まれた物や方法という感じのものです。
つまり、特許を受けることができた発明やそれを独占できる権利です。
他人にマネされたくないと思いませんか？
そんなときは、その発明で特許を目指します。
特許にすることで、あなたが独占でき、他人はマネできなくなります。
ではなく「特許庁」というところに、特許してくださいと願い出ます。
願い出る・・・つまり、「出願」という手続きを行います。
（よく特許を出すことは「申請」と言われますが、厳密には「出願」）
そして、審査にパスすると、その発明が「特許」されます。
こうして特許になった発明が特許発明です。
特許発明を独占できる権利が特許権です。
それは、特許庁の審査官が「特許する」という使い方です。
その前は10年間ほど特許庁に対する出願手続きをやっていました。
つまり、立場が逆転したのです。
再び、特許庁に対する出願手続きなどをやっております。
