How to avoid infringing on others' patents - You can't get away with saying you didn't know [Rewritten version]
(Q) We have developed a new product in-house. We have filed the patent application.
So we are not infringing on others' patents, right?
(A) Filing a patent application and infringing others' patents are two different things.
Apart from filing a patent application, are you infringing on others' patents?
You need to be very careful about this point.
Below are some related points.
■Is it okay to infringe on others' patents if you don't know about their existence?
Is it okay to infringe on others' patents if you don't know about their existence?
No, it's not okay.
Whether you actually know about them or not, you are infringing on others' patents.
If you infringe on others' patents,
✓You may be subject to an injunction against the infringing act.
In other words, you may not be able to continue manufacturing or selling the product.
You may also be ordered to dispose of the product.
✓You may also be sued for damages.
Damages require that the act be intentional or negligent.
If you were not aware of the patents of others, it can be considered neither intentional nor negligent.
However, the situation is different when it comes to patents.
There is a provision called "presumption of negligence."
You are presumed to know the contents of the patented invention.
I will not explain further about the presumption of negligence, but in short,
✓ "I did not know" is not an excuse.
■What can you do to prevent patent infringement
So, what can you do to prevent patent infringement?
That is, to "research" what patents exist.
This is the most reliable way.
Even if you do a patent search yourself, you can find out to a certain extent.
To increase the certainty even more, ask a professional.
They will carry out what is called an "infringement prevention search."
If you ask a patent office with a patent attorney who is good at research, they will be able to handle it.
■ Conduct thorough patent research when developing a new product
Filing a patent application and infringing on other people's patents are two different things.
It is true that if you file a patent application,
✓ a patent office may also conduct a prior art search.
✓ Also, as the patent application review progresses, the results of the review will be useful.
However, the results of prior art searches and reviews are different from "infringement prevention searches."
As your company's products become more complex, the number of patents that may be infringed will also increase.
Be sure to conduct thorough patent research at the appropriate time.
This is especially true when developing a new product that is a gamble for your company's future.
The timing of patent research varies from case to case.
For example, before developing a product, before filing a patent application, before manufacturing a product, etc.
In general, the earlier the better to conduct patent research.
I hope this information is helpful.
