技術の進歩で特許の取り方自体が変わることがあるか？【リライト版】
私たち弁理士も日々研鑚しています。
では、特許の取り方自体が変わることがあるでしょうか？
特許の出願書類の書き方自体が変わることがあるでしょうか？
この点について考えてみました。
例えば、以下のような書き方は、良くないとされています。
【請求項１】…いったん○○度に加熱して冷ました後…を特徴とする…
この書き方が良くない理由は、
✓仮に市場で特許侵害が疑われる物が見つかった
→本当にその特許を侵害しているかがわからないからです。
つまり、その物がいったん○○度に加熱して冷まされたかどうか？
これを判断することができないからです。
高度な物性解析が可能になるかも知れません。
つまり、特許侵害が疑われる物の物性を解析することができる
→製造時にどのような処理が行われたかわかる
→特許侵害の白黒が付けられるようになるかも知れません。
そう言える可能性があります。
特許は最大で20年という長い期間存続し得るものです。
なにが良くてなにが悪いか、一概に言うことは難しいのです。
製法に特徴がある物の発明の特許に限ったお話しではありません。
✓特許とはこういうものとか、
✓特許の出願書類の書き方はこういうもの
という固定観念は、時として弊害です。
日々アップデートすることが重要です。
目の前の１件ごとにその時点での最善を尽くすことが理想です。

I have thought about this point.
■Patents for inventions with distinctive manufacturing processes
As an example, let's consider a patent for an invention with distinctive manufacturing processes.
There are some bad ways to write claims for patents with distinctive manufacturing processes.
For example, the following way of writing is considered bad.
[Claim 1] ...characterized by heating to XX degrees and cooling...
The reason this way of writing is bad is that
✓If a product suspected of patent infringement is found on the market
→it is not clear whether it really infringes the patent.
In other words, whether the product was heated to XX degrees and cooled?
It is because it is not possible to judge this.
But what if science and technology develops?
We may be able to perform advanced physical property analysis.
In other words, we may be able to analyze the physical properties of a product suspected of patent infringement
→ We may be able to determine what processing was performed during manufacturing
→ We may be able to determine whether or not there is patent infringement.
If that happens, then a description like the one in [Claim 1] above is not necessarily a bad thing?
It is possible to say so.
Patents can last for a long period of time, up to 20 years.
It is difficult to say in general terms what is good and what is bad.
■Update how to obtain a patent and how to prepare application documents daily
The above example is just one example.
This is not limited to patents for inventions with unique manufacturing processes.
So what should we do specifically?
