外国での特許も目指すために費用面を重視した３ルートご紹介

確実な特許戦略にしたいのはみんな同じです。
大手企業との違いは、費用面かも知れません。
個人様の場合、金に糸目を付けぬとはいきません。
そこで費用面を重視した外国への特許取得のルートをご紹介です。

①国際出願
②国内出願→国際出願
③国内出願→審査→国際出願
例えば、国内出願よりも国際出願のほうが費用は掛かります。
上記①～③は、費用も利益も①＜②＜③です。
■①国際出願
国際出願（PCT出願とも言います）だけを行うこともできます。
日本を含めた世界各国に出願したのと同等の扱いになります。
国際出願をすると、数か月で審査の結果（見解書）が来ます。
その結果に基づいて、必要な国で権利化を目指すことができます。
■②国内出願→国際出願
まず国内出願を行います。
国内出願から１年以内に、国際出願を行うことができます。
（国際出願以降の流れは、①と同様です）
１年以内に内容を追加することもできます（いわゆる優先権）。
２つの出願を行う利益があることから、①より費用が掛かります。
■③国内出願→審査→国際出願
この③は当ブログでもよく紹介しています。
まず国内出願を行います。
１年以内に審査結果が出るように、国内で審査を受けます。
（特に、個人事業主・社長様の場合、費用低廉＆審査迅速）
その審査結果に基づいて「国際出願を行うか」決めることができます。
✓審査結果が良い場合→外国でも特許が目指しやすくなります。
✓審査結果が悪い場合→断念する場合は、費用は①よりも掛かりません。
世の中には、大きな負担を掛ける前に、まず小さい負担でお試し！
そんなことがよくありますが、③はそれに近いイメージでもあります。

In general, the more profitable a procedure is, the more expensive it tends to be.
For example, international applications are more expensive than domestic applications.
Above ① to ③ are ① < ② < ③ in terms of both cost and profit.
■① International application
You can also file only an international application (also called a PCT application).
It will be treated the same as filing an application in countries around the world, including Japan.
When you file an international application, you will receive the results of the examination (written opinion) in a few months.
Based on the results, you can aim to obtain rights in the necessary countries.
■② Domestic application → International application
First, file a domestic application.
You can file an international application within one year of the domestic application.
(The process after the international application is the same as for ①)
You can also add content within one year (so-called priority).
It is more expensive than ① because there are benefits to filing two applications.
■③ Domestic application → Examination → International application
This ③ is often introduced on this blog.
First, file a domestic application.
You will be examined domestically so that the examination results will be available within one year.
(Especially for sole proprietors and company presidents, the cost is low and the examination is quick)
Based on the examination results, you can decide whether to "file an international application".
✓ If the examination results are good, it will be easier to obtain a patent overseas as well.
✓ If the examination results are poor, if you give up, it will cost less than ①.
It can be said that this provides a good balance between a reliable patent strategy and cost.
People often say that before taking on a big burden, try something small first!
This is a common practice, and ③ is a similar idea.
