「生成AIはAIじゃない」発言から特許をゆる～く学んでみよう
あるネットの著名人がこんな発言をしていました。
この発言はいろんな意味に解釈できて面白いですね。
果たしてこの著名人は、AIの推進派なのか？懐疑派なのか？
せっかくなのでこれを題材にして特許を学んでみませんか？
AI関連の発明で特許が目指せるかも！
AIと特許というと難しい内容のものが多いですね。

生成AIにはさまざまな課題が指摘されています。
例えば、著作権の保護・侵害回避、学習させたくないなど

ただ、アイデアはあるけど、具体的な技術がわからない。

■（２）言葉の定義は適切に！
ただし、特許を目指す際に、気を付けることがあります。
それは、アイデア（発明）の内容を適切に言葉で表現できることです。
＜ポイント＞
✔①辞書に載っている言葉で発明を表現する
✔②造語は、辞書の言葉か造語の組み合わせにより再帰的に定義する
✔③日本語の常識的な表現は認められるが避けたほうがいいものもある
まず①、②ですが、例えば「AI」とはなんでしょうか？
この点をきちんと定義できないと、特許は取れません。
これを議論したらキリがないので、冒頭の発言を取り上げます。
「生成AIはAIじゃないという人がいる」
「生成AI」という表現は「AI」の下位概念と解釈できます（③）。
日本語では通常、修飾語→被修飾語の順になるからです。
例えば、
✔コーヒー牛乳は、あくまで牛乳で、牛乳の下位概念
✔ミルクコーヒーは、あくまでコーヒーで、コーヒーの下位概念
そうすると「生成AIはAIじゃない」は不正解と言えるでしょう。
この点は特許庁の審査でもそう解釈されるでしょう。
（ただし、避けたほうがいいですし、避けられるはずです。）

However, there is something to be careful of when aiming for a patent.
That is, be able to express the content of the idea (invention) in words properly.

✔② Define coined words recursively by combining words in the dictionary or coined words
✔③ Common expressions in Japanese are allowed, but some should be avoided
First, regarding ① and ②, for example, what is "AI"?
If you cannot define this point properly, you will not be able to obtain a patent.
There is no end to discussing this, so let's take up the opening statement.
"Some people say that generative AI is not AI."
The expression "generative AI" can be interpreted as a subordinate concept of "AI" (③).
This is because in Japanese, the order is usually modifier → modified word.
For example,
✔Coffee milk is milk, and is a sub-concept of milk
✔Milk coffee is coffee, and is a sub-concept of coffee
In that case, it would be incorrect to say that "generative AI is not AI."
This point would likely be interpreted that way in the Patent Office's examination.
