特許の審査官との面接の「イロハのイ」【リライト版】
✔その審査官が御社の案件をどの程度担当しているか
✔弁理士が付くかどうか

そんな対応を心がけることです。
拒絶理由通知の対応(いわゆる中間処理)は、論争ではありません。
例えば、補正案の作成などをすることが必要です。
審査官もいい気はしないでしょう。
こちらのメリットが得られなかったらどうしよう!
そんな思考になって、失敗しないようにと緊張するのです。
この点は審査官面接のことで意外によく質問されます。
この点についてはさらに別の記事でも述べてみます。
そう考えると、緊張することも少なくなるのではないでしょうか。
こう考えておいても間違いではありません。
ここまでお読みになってくだされば、ご理解頂けると思います。
少し変わった考え方だったかも知れません。

(Q) I work in the patent department of a company.
The examiner has sent us a notice of rejection regarding our patent application.
I would like to interview the examiner. How should I approach this?
(A) It depends on the following factors, so it is difficult to say.

✔To what extent the examiner is in charge of your company's cases
✔Whether or not you have a patent attorney
There is a very basic way of thinking that is surprisingly often overlooked.
I will explain that way of thinking.
✔It is beneficial for both the applicant (your company) and the examiner!
The key is to respond in this way.
Responding to a notice of rejection (so-called intermediate processing) is not an argument.
The way of responding is the same as in general business.
It is important to be aware of a win-win situation for all involved parties.
If there is one win for the examiner, it is to increase the efficiency of the examination.
For the examiner interview, you need to be well prepared for the examiner.
For example, you need to prepare amendments.
■If you only insist on the benefits for the applicant...
What happens if you only think about your own benefits?
If you only insist on your own benefits and respond in an intimidating manner (lol)...
The examiner will not be happy.
However, there is something more important than that.
That is, you will be "nervous" around the examiner.
What if I don't get the benefits I want!
You will become nervous so that you don't fail.
★"How can I avoid being nervous during an interview with an examiner?"
This is a question I get asked surprisingly often about examiner interviews.
I will discuss this point in another article.
An examiner interview is also beneficial for the other party (the examiner)!
If you think about it like that, you will probably feel less nervous.
■The position of the patent attorney
If you have a patent attorney close to your company, it would be reassuring to have them attend the interview.
So, what kind of position should patent attorneys take?
This is also difficult to generalize, but there are three ways of thinking about it.
① Patent attorneys act as a bridge between applicants and examiners.
This is a common way of thinking.
It's not wrong to think this way.
② Patent attorneys team up with applicants and fight with examiners.
This way of thinking is not desirable.
If you have read this far, I think you will understand.
Rather, if you are going to team up, why not think of it this way?
③ Patent attorneys team up with examiners to work in the interests of applicants.
Examiners are not enemies.
Examiners and patent attorneys are both patent professionals.
It's best to think of them as working together to support applicants.
(Applicants are not necessarily patent professionals.)
■What did you think?
It may have been a slightly unusual way of thinking.
② and ③ above are especially extreme.
All I'm saying is that I recommend thinking closer to option ③ than option ②.
This way of thinking is not because
✔ I was a former Patent Office examiner
✔ Our firm specializes in individuals (who are not necessarily knowledgeable about patents)
but rather because!
I've simply applied a very general business way of thinking to examiner interviews.
