大手新聞のAIと特許に関する記事は専門家でも理解できない
だれでも知っている大手の経済新聞社の記事をご紹介します。
AIと特許に関するネット記事です。ちょっと驚きました。
ポイントを抜き出すと、
①科学技術相は記者会見で、人工知能（AI）を使った発明について開発者の特許権を認める検討に入ったと明かした。
②AIの開発者も「共同発明者」として扱う方向で政府計画に方針を反映する。
③発明者として認められたAI開発者は特許使用料などの対価を受け取れるようになる。
④現在の法制度ではAIそのものは発明者として認めていない。AIが自律的に発明などの創作をすることはない。
■①科学技術相は記者会見で、人工知能（AI）を使った発明について開発者の特許権を認める検討に入ったと明かした。
マスコミ用語？科学技術省という省庁があるみたいですね。
ちなみに、特許を扱うのは特許庁です。経済産業省の外局です。
■②AIの開発者も「共同発明者」として扱う方向で政府計画に方針を反映する
上記①の後半と②については、例えばこんなケースが考えられます。
✔プログラム（AI？）を作った人がいて、発明に多大な貢献をした
このような場合は、そのプログラム作成者が発明者になり得ます。
一般的な生成AI（業者）と呼ばれるものはこれには当たりません＾＾；
■③発明者として認められたAI開発者は特許使用料などの対価を受け取れるようになる。
特許権者が、特許使用料などの対価を受け取れることはあるでしょう。
ただ発明者＝特許権者とは限りません。
特許権者は、特許の書類に「特許出願人」として記載された者です。
まして上記の生成AIの業者などはこれには当たりません＾＾；
まるで生成AIの業者が特許使用料などの対価を受け取れるようです。
大手経済新聞の記事にしては雑に感じます。
■④現在の法制度ではAIそのものは発明者として認めていない。AIが自律的に発明などの創作をすることはない。
この④は特許庁との見解とも一致します。
私たちのAIに対する理解とも一致しますね。
「現在の」とありますが、今後も同じでしょう＾＾；前半も後半も
■ニュースのエンタメ化を楽しみましょう
「ニュースのエンタメ化」と言われて久しいですね。
だからといって社会や私たちが混乱することもありません。
