特徴が2つある商品でも1つの特徴だけで特許を目指した方がいい理由【リライト版】
限定しない→何でもいいということです。
「収納部と留め金の両方に特徴があるカバン」
について、あとから他者に特許を取られる心配もないでしょう。
✔(アイデアのある)収納部が同じで、
✔(アイデアのない)留め金がわずかに異なる
そんなカバンを作ることができてしまい、十分に保護できません。
・・・収納部を有するカバン。
請求項1に記載のカバンにおいて、さらに・・・の留め金を有する。
このような請求項を「従属項」や「引用形式請求項」と言います。
相乗効果がない場合、請求項2の意味はあまりありません。
というと必ずしもそういうわけでもありません。
この点は、勘違いされることも多いのですが、
発明を限定していく(具体的な商品に近づけていく)
→限定の仕方が悪いと、特許性を高めることにはなりません。






そこで、別々の特許出願をすることになります。
つまり、収納部と留め金のいずれか一方の特許出願のみで十分です。
ただ、どのような特許を目指せばよいかが煩雑になりがちです。

Others can easily imitate it. In other words, they could make a bag with the same storage section (with an idea) and a slightly different clasp (without an idea), which would not be adequately protected.

In this case, the combination of the two is one idea.
