特許出願から１年以内に審査結果（特許ｏｒ拒絶）が出たときにできること【リライト版】
本記事ではこのとき可能な対応について、ご紹介します。
（１）特許になった、または、（２）特許が拒絶された
ということです。
一次審査的な意味合いの、拒絶理由通知のことではありません。
そう思われるかも知れません。
「１年以内」という状況においては、その後にできることがあります。
ここでは「１年以内」に特化した手続きをご紹介します。
ご参考にどうぞ。
外国での特許取得を希望されることがあるでしょう。
１年以内であれば、外国での特許取得を目指せます。
同じ内容については、最初の出願日を維持したままで可能です。
パリ条約という条約に基づく権利です（以下、パリ優先権）。
パリ優先権を主張して、国際特許出願（ＰＣＴ出願）も可能です。
内容を追加することで、より包括的な特許取得が目指せます。
（追加部分については、最初の出願日を維持することはできません。）
日本で特許になったのです。外国でも特許される期待が高まります。
上記の国際特許出願では、日本へは、パリ優先権を主張できません。
最初の特許出願の際にちょっとした工夫が必要です。
パリ優先権を主張して、日本での包括的な権利化を目指せます。
この点については、別途述べたいと思います。
（ここで述べるまでもなくさまざまな情報あります。）
拒絶査定が１年以内である場合には、別の対策が一つあります。
（以下、国内優先権といいます。）
国内優先権を主張することによって、再チャレンジできます。
内容を追加することで、より包括的な特許取得が目指せます。
✔特許出願された発明が従来の発明と類似している（進歩性なし）
審査官から、従来の発明について、文献などが提示されます。
また、発明を改良等することもできます。
従来の発明との違いを主張できる可能性を高められます。
しかし、国内優先権を主張する出願は、最初の出願とは別の出願です。
新たな事項を追加することもできます。
出願手数料や審査請求料は、出願ごとに掛かります。ご注意ください。
近年、特許庁の運用が以下のように改善されているからです。
一年以内に特許または拒絶の審査結果が出ることも多くなりました。
一定期間、特許印紙代の減免措置があります。

Here, we will introduce procedures that are specialized for "within one year."
Please use this as a reference.
(1) If the patent is granted within one year of filing a patent application
You can aim to obtain a patent abroad.
You have gone through the trouble of getting a patent.
You may wish to obtain a patent abroad.
If it is within one year, you can aim to obtain a patent abroad.
This is possible while maintaining the initial application date for the same content.
This type of treatment is called "priority."
This is a right based on the Paris Convention (hereafter referred to as Paris priority).
It is also possible to claim Paris priority and file an international patent application (PCT application).
When claiming Paris priority, you can also add content.
By adding content, you can aim to obtain a more comprehensive patent.
(The initial application date cannot be maintained for the added part.)
The examination by the Japan Patent Office is said to be excellent and reliable.
It was patented in Japan. Hopes are high that it will be patented in other countries as well.
(Note) However, there is a caution.
This is about filing an international patent application claiming the above Paris priority.
With the above international patent application, you cannot claim Paris priority in Japan.
A little ingenuity is required when filing the initial patent application.
By claiming Paris priority, you can aim to obtain comprehensive rights in Japan.
I would like to discuss this point separately.
(2) If a patent is rejected within one year of filing a patent application
General countermeasures (such as appeals against a rejection decision) will be omitted.
(There is a lot of information that goes without saying here.)
If the decision of refusal is within one year, there is another measure.
You can claim priority, which is only valid in Japan.
(Hereinafter referred to as domestic priority.)
By claiming domestic priority, you can try again.
You can also add content when claiming domestic priority.
By adding content, you can aim to obtain a more comprehensive patent.
(You cannot maintain the initial application date for the added part.)
■Benefits of claiming domestic priority when your application is rejected within one year of filing
There are also the following benefits to claiming domestic priority.
The majority of reasons why an initial patent application is rejected are:
✔The invention applied for is similar to a previous invention (no inventive step)
The examiner will present literature, etc. about the previous invention.
Therefore, when applying for domestic priority, you can claim the differences from that previous invention.
You can also improve the invention, etc.
This increases the chances of claiming the differences from the previous invention.
You cannot add new matter that was not initially disclosed in a single application.
However, an application claiming domestic priority is a different application from the first application.
New matters can also be added.
The advantages of domestic priority are as mentioned above, but the disadvantage is the cost.

● Compatible with the latest Patent Office operations
The contents written in this article can be said to be a relatively new way of thinking.
This is because the operations of the Patent Office have been improved in recent years as follows.
① Examination results are now available more quickly.
Especially when the applicant is a small business owner, self-employed person, individual, etc.
It is becoming more common for the examination results to be either patented or rejected to be issued within a year.
(I also struggled with deadlines when I was an examiner!)
② The financial burden has been reduced.
This is limited to applicants such as small business owners, self-employed people, and individuals.
There is a reduction in patent stamp duty for a certain period of time.
Even if you file an additional patent application, the financial burden has become much less.
