パテントトロールの対策が本格化されるといいな【リライト版】

「パテントトロール」の知識も身に付きます。
いずれにしろわたしは、パテントトロールへの対策に賛成派です。
そこで、パテントトロールについて私見を述べてみたいと思います。
✔投資目的で特許を売買する者
特に、このことが問題視される傾向にあります。
✔小規模のパテントトロールが、大手の企業に対して特許権を行使
ここでそれらの意見をとり上げるのは控えます。
ただ、国が対策に乗り出すということです。
パテントトロールに少なからず弊害があるというのは共通の認識です。
その弊害の部分について、対策が施されていくことが期待されます。
「小さな企業が特許を取ることは良くない」
そんな、十把一絡げの議論に、歪曲されることがあります。
これはさすがにとんでもない意見です。
特許取得のための料金の軽減措置を講じているくらいです。
また、正当な権利（特許権）の主張は、本来の姿です。
すべてをパテントトロールとレッテル張りしてよいはずがありません。
これらの点が、明らかになっていけばと思います。
→「特許を適正に利用する小さな企業」がより適切に保護される
こんなことが期待されます。すなわち、
＝「特許制度を適正に利用しようとする小さな企業」
✔特許制度そのものの議論に発展することにつながります。
特許制度も、制度疲労を起こしている部分があるかと思います。
時代とともに特許制度の細かい部分が改良されていく！
このことは、産業界全体にとってのメリットです。
小さな事業者こそ、本来、特許で保護されるべき対象だからです。
✔十分な特許調査を行い、トロールよりも先に特許を押さえる
特許調査の環境も、そのスキルを持った者も、充実してきました。
特許のプロである私たち弁理士にとっても、好ましいことです。
