<目次>

How should a patent attorney (patent office) handle the invention of a perpetual motion machine? [Rewritten version]
I learned more about technology from YouTube.
After all, the explanation in the video is easy to understand! It's a good time.
The other day, I learned about perpetual motion machines.
One video about perpetual motion motion was very interesting.
At first glance, they were introducing something that looked like a perpetual motion machine.
And "Why is it not established as a perpetual motion machine?"
It was compiled from the perspective of providing this explanation.
It was also very meaningful to review thermodynamics.
The number of views is also quite high.
It seems that many people are interested in perpetual motion machines.
Therefore, in this article, we will touch on perpetual motion machines from the perspective of patents.
Let's say you receive a request to say, "I've invented a perpetual motion machine!"
“Why isn’t it established as a perpetual motion machine?”
There may be times when this cannot be determined immediately.
How should a patent attorney (patent office) handle such a case?
I will explain using the example of our firm: Shinonome Patent Office (Shinonome Patent Office).
<Table of contents>
(1) We will not immediately refuse your request.
(2) Even if it is not a perpetual motion machine, there is a possibility of an energy efficient machine.
(3) We will inform the customer of all circumstances and discuss them together.
■(1) We will not immediately decline your request.
"A perpetual motion machine is scientifically impossible!"
It's easy if you just tell me that.
However, I have no dreams or hopes for such a refusal!
I believe that questioning common sense is one of the important tasks of a patent attorney.
First, we seriously listen to the customer's theory.
■(2) Even if it is not a perpetual motion machine, there is a possibility of an energy efficient machine.
If it really was a perpetual motion machine, it would be a great patent.
However, patents are not limited to perpetual motion machines (of course).
Even if it is not a perpetual motion machine, it will be patented as a normal invention.
For example, it could be an energy-efficient engine.
Specifically, for example,
✔ Utilize nature (gravity, sun, ocean, etc.)
✔ Utilize energy that is overlooked (e.g. the power of people passing through station ticket gates)
Even if it is not a perpetual motion machine, the invention may be successful.
It's fun to invent something that resembles a perpetual motion machine!
■(3) We will inform the customer of all circumstances and discuss them together.
After obtaining a patent, it is up to the inventor how to utilize the patent.
This point is the same for perpetual motion machines and anything that resembles a perpetual motion machine.
Of course, the same is true for general inventions.
We will inform our customers of all these circumstances.
After that, let's discuss together whether to issue a patent.
■Supplementary information
What did you think?
✔When we issue a patent for a perpetual motion machine invention (according to the customer)
→Documents do not contain conclusive statements such as "it is a perpetual motion machine."
✔If you are an individual inventor and issue a patent for your own "perpetual motion machine" invention
→How will the examiner examine the invention?
If you cannot immediately determine whether or not it is a perpetual motion machine, how should you handle it?
For more information on this, please see this article.
(I have expressed some ideas based on my experience as an examiner)
