商標のくじに参加してみて（１）商標がくじで決定される？
今後ブログで、気づいた点を書いていきたいと思います。
本記事では、なんのことかわからない方に向けて解説です。
厳密性よりもわかりやすさを優先します。
■商標がくじで決定される？
よく、商標は早い者勝ちと言われます！
（同一または類似の商品・サービスで、同一または類似の商標の場合）
つまりこういうことです。
（ ↑ 画像をクリックすると詳細ページに飛べます！）
✔同一または類似の商標について異なる者が商標を出した場合
→最先の出願人のみが商標登録を受けることができる
✔同日だった場合は？
→協議によって定められた者が商標登録を受けることができる
✔協議が成立しなかったときは？
→公平な方法によるくじにより商標登録を受ける者が決められる
まずは話し合って、ダメならくじでということですね。
ちなみに特許では、話し合ってダメな場合、すべて特許されません。

✔ What if the consultation is not established?
→ The person to be registered as a trademark is decided by a lottery in a fair manner.
First of all, talk and if it doesn't work, it's a lottery.
By the way, in the case of patents, if the discussion is not good, all patents will not be granted.
