そんなニュースを見ました。大反響で入手困難だそうですね。

以前『NHKが映らないテレビ』が話題になったのを思い出しました。

特殊な機器で、NHKが写らないようにするものです。
『イラネッチケー』という名称だったと思います。
名前は面白いですね。

■NHKはイラネッチケーを製造できないように妨害している？

イラネッチケーについて、ある影響力がある方が、こんな趣旨の発言。

①NHKは特許をたくさん持って、技術を独占している。
②NHKはイラネッチケーのようなものの開発を特許で妨害している。

①は事実として正しいです。

ただ、②は考え方が間違っています。
影響力ある方の発言ですので、当ブログで補足します。

■特許の「独占」の趣旨とは？

たしかに、特許とは、技術を独占できるものです。
特許は、産業の発達のために、発明の保護と利用を図るものです。

✔発明の保護：権利者に発明を一定期間独占させて保護する
✔発明の利用：一定期間後は他者も利用できる（ジェネリック）

特許の「独占」は、権利者だけが製造等できるという意味です。

特許は、権利者が製造等することを期待して付与するものです。
だれにも製造させないという意味ではありません。
それでは産業の発達が図れないからです。

■特許は他者が製造できないように妨害するものではない

イラネッチケーに関する特許があったとしましょう。
NHKが特許を取り、NHKだけがイラネッチケーを作れるとします。

これは「だれにも作らせない」という意味ではありません。

影響力ある方の発言②はこの点を誤解しています。

もちろん、NHKが製造できない事情があることもあるでしょう。
結果的に「作るのを妨害している」ように見えるかも知れません。

ただその場合でも、他者が、製造の申し出をすることはできます。

いわゆるライセンス契約です。
ライセンス料も一般的な額になることでしょう。
（NHKはその公的性から、法外なライセンス料にはできないでしょう）

ですので「特許で作るのを妨害する」なんてことはできないのです。
