About the description in the [Symbol Explanation] column of patent application documents [Rewritten version]
(Q) I heard that in patent application documents,
✓Only symbols are described in the drawings, and symbol explanations are described in the specification.
Do you have to explain all the symbols in the drawings in the [Symbol Explanation] column?
(A) There is no particular rule that will cause a patent to be rejected if you do not do this.
Below are some ways of thinking and their characteristics.
■①Explain all symbols that appear in the drawings
Explain the symbols that appear in the drawings in the [Symbol Explanation] column of the specification.
You can also list all the symbols and explain their names.
The symbol explanation column can be used as a dictionary, table of contents, or heading.
When application documents are published as patent gazettes, they are read by many people.
When reading patent gazettes, you may first look at the drawings.
If all the symbols that appear in the drawings are explained, it is easy to understand.
It is easy to understand for readers, including the applicant himself.
■② Explain only the components that appear in the claims.
There are many patent applications like this.
(I saw many of them when I was an examiner.)
It can be difficult to explain all the symbols in detail.
So sometimes only the important components are explained.
One example is the components that appear in the claims.
This may be an agreement between the patent office and the client.
If you are filing a patent as an individual, you don't need to be too conscious of this ②.
The claims in the claims may be amended after filing.
In this respect, too, you don't necessarily need to think too strictly about this ②.
(I think the idea of explaining only the important components is good.)
■③ <Reference> Indicate the explanation of the symbols in the drawings.
You can also include the explanation (name) of the symbols in the drawings.
Like ①, this is a method that takes the reader into consideration.
③ is not often seen, but it is not particularly prohibited.
It is the easiest for the reader to understand, but it may be in the minority.
One reason for this is that the same content may also be filed abroad.
There is a risk of problems with translating the drawings.
If it is confirmed that only domestic applications will be filed, then option ③ is also an option.
Even in the case of option ③, it is a good idea to include a column for [Explanation of symbols].
■Good points to keep in mind when writing patent application documents
What did you think?
Not just in regards to the points mentioned here, but with regards to how to write patent application documents,
✓You can write freely as long as it is not a reason for the patent to be rejected.
(No examiner will get angry if you do that!)
✓The best way to write application documents can change with the times.
(Don't be bound by stereotypes about how things have always been done!)
It's a good idea to keep these things in mind.
I hope this is helpful.
