Patents you want to get for yourself and patents you don't want others to get [Rewritten version]
There are two main reasons for filing a patent application.
① You want to get a patent for yourself (active patent)
② You want to prevent others (other people) from getting a patent (passive patent)
① can also be said to be preventing others from copying.
② can also be said to be not wanting others to interfere with your company's manufacturing and sales.
Patent application documents include various details about the invention.
What should you do to achieve the above goals?
What should you write in which part of the application documents?
*
Patent application documents include claims, specification, drawings, and abstract.
In the following, the specification and drawings are collectively referred to as "specification, etc."
We will also omit the explanation of the abstract.
① About the contents you want your company to patent
The contents you want your company to patent should be written in the "claims."
In the "claims" column, write the invention in separate sections.
The invention described in this claim is the invention for which you are aiming to obtain a patent.
The specification etc. should include an explanation of the invention described in the claim.
At the very least, it should be explained so that the thing can be made and used (★1)
② About the contents you want to prevent other companies from patenting
The contents you want other companies to not patent should be written "somewhere" in the document.
The application documents will be made public after a set period of time.
Other companies will not be able to patent the whole of what is written in the application documents.
Other companies will not be able to patent anything written somewhere in the patent documents.
This applies not only to the claims, but also to the contents written in the specification etc. (★2)
Furthermore, the same applies to inventions that can be easily invented from those contents.
Other companies will not be able to patent anything.
*
In other words, this is what it means.
The contents you want to patent yourself should be written in the claims.
The specifications etc. must include the contents of (★1).
You can also include contents aimed at (★2) in the specifications etc.
<Example>
Let's say that invention A1 is described in the claims of a patent.
Let's say that invention A1 and invention A2, which is an improvement of invention A1, are described in the specification.
Invention A1 is the content that can be patented by your company.
On the other hand, inventions A1 and A2 are the content that other companies cannot patent.
The same goes for inventions that can be easily invented from inventions A1 and A2.
Other companies will not be able to obtain patents.
*
In the above example, the invention described in the specification was "improved invention A2."
However, the invention described in the specification is not necessarily limited to this.
It does not have to be related to invention A1.
(There may be no point in describing an invention that is too unrelated.)
Consider carefully what content to include in the specification.
For example, suppose there is an invention that
✔ does not need to be patented by your company
✔ but that you do not want other companies to patent.
You can only describe such inventions in the specification.
(Note)
This is just an image.
We have intentionally omitted precise legal explanations.
There may be cases where you file a strategic patent application like the one described in this article.
Please be sure to consult with a patent office (patent attorney).
