報道機関をＡＩから守るために著作権法は改正されるのか？
こんなタイトルのニュース記事を見かけました＾＾；
■報道機関をＡＩから守るために著作権法は改正されるのか？
上記ニュース記事のポイントは、
✔Googleなど検索エンジンで生成ＡＩが書いた記事が回答される
✔ユーザはニュースサイトを見なくなる（ゼロクリックサーチ）
✔生成ＡＩが書いた記事は、情報の切り貼りで、正確性に欠ける
✔著作権法をはじめとした知的財産諸法の見直しを求めた
これに対するネット民の反応は辛辣でした＾＾；ブーメランだよね
ちょうど先日、当ブログでもこんな記事を書きました。
「意匠権でビジネスが守れる」はフェイク？【ファクトチェック】
上記は、大手メディアのニュースです。
情報の切り貼りで、正確性に欠けていました＾＾；
なんなら、報道機関の元記事を、ＡＩがリライトしたら正確になる？
そんなことすらあるかも知れません＾＾；
ただ、今回の件に関しては、報道機関が気の毒に思えます。
■一弁理士としての個人的な意見
（１）著作権法は改正されるのか？
今回の件に関しては、報道機関が気の毒に思えます＾＾；本当です
著作権法の改正はかなり難しいと思われます。
ＡＩの活動というのは、人間の活動と本質的には変わりません。
ＡＩの活動を著作権で規制すると、同様に人間の活動も規制されます。
例えばブログで収益をあげる個人も著作権法に触れることになります。
（２）ではどうするか？
では、報道機関はどうするか？
踏み込んだ取材等によって、内容に独自性を出すしかないでしょう。
独自の内容であれば、ＡＩが利用したことを認定しやすくなります。
（いわゆる著作物の「依拠」が認定されやすくなります。）
どこにでもあるような平凡な記事は、価値がなくなりつつあります。
このことが中長期的に見て良いのか悪いのか、見守りたいと思います。
著作権法に動きがあれば、またブログを書いてみたいと思います。

It was cut and pasted and lacked accuracy ^^;
If anything, if AI rewrites the original article from a news organization, will it be accurate?
That may even be the case ^^;
However, in this case, I feel sorry for the media.
■Personal opinion as a patent attorney
(1) Will the Copyright Act be revised?
In this case, I feel sorry for the media ^^; It's true.
I think it will be quite difficult to revise the Copyright Act.
AI activities are essentially the same as human activities.
The processing speed is simply different.
If AI activities are regulated by copyright, human activities will also be regulated in the same way.
For example, individuals who make money from blogs will also be in violation of the Copyright Act.
What to do about (2)?
So what will media organizations do?
They will have no choice but to make the content unique by conducting in-depth interviews, etc.
If the content is unique, it will be easier to determine that it was used by AI.
(It will be easier to determine the so-called "reliance" on copyrighted works.)
Ordinary articles that can be found anywhere are losing their value.
I would like to keep an eye on whether this is good or bad in the medium to long term.
