ＡＩを発明者とした特許が門前払いになったというお話し
こんなタイトルのネットニュース記事を見かけました。
特許の専門家として、ツッコんで…ではなく解説してみます＾＾；
雑談のネタにはなるかと思います＾＾；
上記ニュースからキーワードを抜き出すと、

■実際はどうだったのか？
特許出願において、発明者が人間でない場合、補正命令となります。
補正命令に適切に対応しないと、特許出願は却下されます。

この却下処分に対して、地裁に訴訟を起こしたが、認められなかった。
実際はこういうことと考えられます。

特許出願が却下されると、特許の中身は公開されません。
「AIが発明した新技術」は、どこから得た情報なのか？
また「特許として認められるかが争点」は完全な誤解でしょう。
大手メディアのニュースにしてはずいぶん雑な感じです＾＾；
ニュース自体、AIが書いているのかな？＾＾；
■②判決は「発明者は人間に限られる」
発明者が人間以外だったらどうなるか？について考えてみましょう。
例えば、蜂の巣の「ハニカム構造」は偉大な発明！
そこで蜂に特許を与えたとします（笑）
その特許を利用したい人は、蜂にライセンス料を払うの？＾＾；
発明者が人間に限られることには、一定の合理性があるのです。
また例えば、AIが発明をする？本当にそんなことが起こるなら・・・
そのAIを使う人間が、こっそり特許を取ればいいんじゃないの？＾＾；
■③AIの発達が想定されていなかった→新たな特許制度設計が必要？
いろいろツッコんで、じゃなくて解説してみました＾＾；
別のニュースで、特許庁がAIのことで懸念ということでした。
今回のニュースのようなことなのでしょうね＾＾；特許庁も大変だ
そういえば今回のニュースに、ネット民がこんなコメントです。
「訴訟そのものよりAIの宣伝を目的としたくだらない訴訟」
同感の方も多いと思います。わたしもそうです。
