特許取得を目指すための「発明の改良」とは?考え方3つ【リライト版】
✔その特許が意図しない内容だったら、意味がありません。
例えば、実際の製品が守れない特許では意味がありません。
3つの考え方をご紹介します。
それぞれ、メリット・デメリットをご説明します。






特許性が高まります。
構成要素Cがその発明の技術分野において知られているもの
→Cを付加することが容易であるとして、進歩性を否定されやすい
「発明の改良」というよりは「製品の改良」に近いとも言えます。
特許性が高まります。
内的付加をしていけば必ず特許が取れるとさえ言われます。

→他者がそこを真似できないので、他者製品との競合優位性が高まる
同じ内的付加でもこのような意識が重要です!
→進歩性を否定されやすくなります。
→改良発明によって実質的にもとの発明の製品やビジネスを守れる
この点が重要です!
→一つの出願で包括的な権利取得が目指せなくなります。

✔(2) Improvements that limit the constituent elements of the invention (internal addition)
✔(3) Improvement to consider what further problems the invention may have
■(1) Improvements that add constituent elements of the invention (external addition)
It is an improvement that adds the constituent elements of an invention.
It is also sometimes referred to as an "external addition."
As you add more components, the scope of your invention narrows.
This is because the number of AND conditions will increase.
Narrowing the scope of an invention differentiates it from other patents (prior patents).
Increases patentability.
For example, suppose invention 1 consists of components A and B.
Suppose that Invention 1 is improved by adding component C to Invention 2.
Invention 2 has components A+B+C.
<Advantages>
It can be improved relatively easily.
<Disadvantages>
It does not increase patentability that much.
Component C is known in the technical field of the invention
→The inventive step is likely to be denied because it is easy to add C.
It can be said that this is closer to "improving a product" than "improving an invention."
■(2) Improvements that limit the constituent elements of the invention (internal addition)
This is an improvement that limits (deeply digs) the constituent elements of an invention.
This is sometimes called "internal addition."
As you limit the components, the scope of your invention literally becomes narrower.
Narrowing the scope of an invention differentiates it from other patents (prior patents).
Increases patentability.
For example, suppose invention 1 consists of components A and B.
Suppose that Invention 2 is created by improving Invention 1 by limiting component B.
Invention 2 has constituent elements A+b (b is a subordinate concept of B, etc.).
<Advantages>
✔ Patentability is slightly increased.
It is even said that if you make internal additions, you will definitely get a patent.

✔ Internally added content is a pinpoint important element of the product
→Since others cannot imitate it, competitive advantage with other companies' products increases.
This kind of awareness is important even for the same internal addition!
